California Rosenthal Fair Debt Collection Practices Act

The pressure that a debt collector can put on a person can be unbearable.  Sometimes it is hard to make ends meet, and the added stress of debt collectors coming for their money is unnecessary.  Consumers are provided protection from harassment and abuse through the Fair Debt Collection Practices Act in California. Cal Civ Code §§1788 to 1788.33, 1812 to 1812.072

Consumers who reside in the state of California are provided added protection.  While the Federal Fair Debt Collection Practices Act applies only to debt collection agencies and not the original creditors, California law extends the protection to creditors as well.  Also known as the Rosenthal Fair Debt Collection Practices Act, the law mirrors the Fair Debt Collection Practices Act and applies the act to creditors.   Also, just like the FDCPA, the California state law also provides for statutory damages of at least $100 and up to $1,000, plus the award of reasonable attorney fees and costs.
